This Podcast Guest Release (“Release”) is between Triggs Media LLC, doing business as Overcoming to Live Well (“Producer”), and the guest completing the form below (“Guest”).
1. CONSENT TO RECORD
Guest voluntarily consents to the audio and video recording of Guest’s interview, conversation and related participation.
2. RIGHTS GRANTED
Guest grants Producer a worldwide, perpetual, royalty-free right to record, reproduce, edit, adapt, publish, distribute, publicly perform, display and otherwise use the recording, in whole or in part, in any media now known or later developed, including podcast platforms, websites, social media, advertising and promotional clips.
3. NAME, VOICE AND LIKENESS
Guest authorizes Producer to use Guest’s name, voice, image, likeness, approved biography and approved professional title in connection with the program and its promotion.
4. EDITING AND PUBLICATION
Producer may edit the recording for length, clarity, format and promotion, provided the edit does not intentionally create a materially false portrayal of Guest. Producer has no obligation to publish the recording, and Guest has no right of prior review or approval unless separately agreed in writing.
5. GUEST-SUPPLIED MATERIALS
Guest represents that Guest owns or has permission to provide any photographs, video, audio or other materials supplied to Producer and grants Producer the same rights to use those materials in connection with the program and its promotion.
6. SENSITIVE AND THIRD-PARTY INFORMATION
Guest agrees not to disclose classified, export-controlled, confidential, operationally sensitive, legally restricted or unauthorized third-party information. Guest is responsible for deciding what Guest is authorized and comfortable to share.
7. COMPENSATION AND OWNERSHIP
Unless the parties agree otherwise in writing, Guest will receive no payment and will have no ownership interest in the recording or revenue derived from it. Guest retains ownership of Guest’s pre-existing intellectual property.
8. RELEASE OF CLAIMS
To the fullest extent permitted by law, Guest releases Producer and its representatives, distributors and platforms from claims arising from the authorized recording, editing, publication or promotion, including claims based on privacy, publicity or use of likeness, except for claims arising from willful misconduct or uses outside this Release.
9. CONTINUING PERMISSION
Guest understands that distributed content cannot reliably be recalled. These permissions continue after recording and may be withdrawn only through a written agreement signed by Producer.
10. AUTHORITY AND GOVERNING LAW
Guest confirms that Guest is at least 18 years old, has authority to sign, has read this Release and signs voluntarily. Texas law governs this Release, without regard to conflict-of-law principles.
